Fast, Fair and Legally Binding Resolution
Construction adjudication provides a rapid, cost‑effective and enforceable method for resolving disputes under the Housing Grants, Construction and Regeneration Act 1996. It is designed to keep projects moving while giving parties a clear, reasoned decision within a strict statutory timetable. My adjudication work focuses on delivering fair, balanced and evidence‑based determinations that parties can rely on.
What is Construction Adjudication
Adjudication is a statutory dispute resolution process available to most UK construction contracts. Either party may refer a dispute to an independent adjudicator, who must reach a decision within 28 days unless the parties agree to extend the period. The process is private, flexible and significantly faster than litigation or arbitration, making it well suited to technical, valuation and contractual disputes.
When Adjudication Applies
Adjudication applies when a dispute has crystallised under a construction contract. It is commonly used for issues involving payment, valuation, variations, delay, disruption, defects and contractual interpretation. If one party believes a contractual entitlement has been wrongly withheld or challenged, adjudication provides a structured and enforceable route to resolution.
Types of Disputes Commonly Referred
Construction adjudication is used for a wide range of disputes, including non‑payment, under‑payment, disputed applications, invalid pay less notices, valuation disagreements, delay and disruption claims, extensions of time, loss and expense, defects, omissions and final account issues. It is equally suited to technical quantum matters and contractual interpretation disputes.
My Role as Adjudicator
As adjudicator, I review the parties’ submissions, contractual documents, evidence and expert material to reach a fair and reasoned determination. My approach is grounded in procedural fairness, clear analysis and practical understanding of construction operations. With over 35 years’ industry experience and extensive adjudication practice, I provide decisions that are robust, balanced and technically sound.
Why Appoint Me
Parties appoint me because I bring deep experience in construction contracts, quantum assessment and delay analysis, combined with a clear and structured decision‑making style. I manage the adjudication timetable efficiently, ensure both parties are heard, and deliver determinations that are well reasoned and enforceable. My focus is always on fairness, clarity and practical resolution.
The Adjudication Process
The adjudication process typically begins with a Notice of Adjudication, followed by the appointment of an adjudicator and submission of the Referral Notice. The responding party then provides its Response, and further submissions may be permitted depending on the circumstances. I may hold a meeting or site visit if required. A reasoned decision is issued within 28 days, unless extended by agreement.
Frequently Asked Questions
Adjudication decisions are binding on an interim basis and enforceable through the Technology and Construction Court. Challenges are rare and generally limited to procedural issues. Most adjudications conclude within 28 days, though extensions can be agreed. Parties typically provide contract documents, payment records, programmes, correspondence and contemporaneous evidence. Legal representation is optional but commonly used.
